Terms and conditions
The following terms and conditions govern your use of this site and your purchase of products through this site. By using this site, by placing an order with us, you are indicating your acceptance of the following terms and conditions (the “Terms and Conditions”). The Terms and Conditions supplement any subsequent terms or conditions included in any purchase order, whether or not such terms or conditions are signed by us. We reserve the right to make changes to this site and these Terms and Conditions at any time.
Copyright
The parties declare not only that they are aware of the law on copyright, but that they want the artist, in addition to retaining the right of ownership and control over his work, to participate in the increase in value to which it will be subject as influenced by any other work that the artist has created or will subsequently create.
art.1) The artist directly transfers the work to the buyer, who accepts, in the conditions described and specified for the price already agreed and accepted for the evaluation of the work.
art.2) The buyer, for himself and for his heirs and/or assigns, undertakes to transfer the work with the methods contemplated in the following articles. 14-15 also binding themselves, in the aforementioned capacity, in the event that, in the future, the work purchased today is sold, sold, donated, pledged, exchanged, assigned, and/or in any case transferred, even mortis causa, in by force of law (and/or in the case in which the work has been destroyed the value is paid) to send to the artist or his agent, within thirty days of the transfer, a copy of the complete transfer deed of the indication of the data of the new buyer and the price and value of the work together with 11 15% of the amount resulting from the difference between the sale price and the value indicated in the immediately preceding Transfer Deed.
art. 3) The buyer for himself and for his heirs and/or assigns (including executors, curators etc.) declares that he will be directly responsible towards the artist, knowing that he will act, if and when he transfers the work, in the capacity as depositary for all legal purposes pursuant to art. 1782 cod. civ, of the percentage sum reserved for the artist
art. 4) The parties agree that the artist with this contract does not alienate or give away to the buyer, not even in part, the right to reproduce and use both the work and its image.
art. 5) The parties agree that, in the event that the purchaser provides the possibility of reproducing and/or using the work and/or its image, the purchaser must first consult the artist to obtain written consent.
art. 6) The parties agree that the buyer must request in writing from the artist permission to exhibit the work in both private and public art exhibitions and/or exhibitions. In the request, the buyer must indicate the nature of the exhibition, the name of the organizer and the names of the participants. The artist may communicate in writing to the buyer, within thirty days of his request, his veto against the work covered by this contract being exhibited.
art. 7) The buyer undertakes to lend the work to the artist, without being able to claim compensation, for a period, even if not continuous, of sixty days for every five years starting from the day of the last transfer.
art. 8) If the artist requests the purchaser to have the work for a longer time than that referred to in the previous article, he must pay the purchaser a sum equal to 50% of the rights and/or compensation possibly received for the exhibition of the work. Opera.
art. 9) In the cases provided for in the previous articles. 8-9 the buyer will have to insure the work with a primary insurance company.
art. 10) The buyer undertakes not to modify, alter, destroy or damage the work in order to always keep it in its original conditions.
art. 11) The buyer undertakes to consult the artist in advance in cases where the work has been modified, altered, destroyed or damaged and the artist mutually undertakes to provide his assistance work free of charge.
art. 12) In cases where the buyer receives rights or compensation for the display of the work in both public and private exhibitions, he must pay the artist (or his agent) 50% of these compensations within thirty days from the date in which he will have collected them. art.
art. 13) The work is transferred accompanied by the notice which attests to the authenticity of the work and the existence of this contract so that all those who purchase or come into possession of the work or transfer it, intend to exhibit it, reproduce it and/or use it are subject and obliged to comply with all the clauses of this agreement.
art. 14) The buyer undertakes, in the event that the work is subsequently transferred in any way, to bring to the attention of the assignees the binding existence of this contract by having them sign the Transfer Deed completed in its entirety , as well as to fulfill the obligations referred to in the art. 3.
art. 15) The artist will recognize as authentic only the work transferred in the manner referred to in the previous articles.
art. 16) this contract will remain fully effective between the parties and their heirs and/or assigns for the entire life of the artist and for fifty years following his death. The provisions of the articles. 7-8 are valid for the entire duration of the Artist's life.
art. 17) The parties already agree and recognize that from non-compliance with the clauses provided for in the articles. 3-7-8-9-12-15 of this contract causes serious damages to the artist which are susceptible to economic evaluation.
art. 18) All possible disputes that may arise between the parties and/or their heirs and/or assignees regarding the interpretation and application of this contract will be referred to the judgment of an arbitrator appointed by the Superintendent of Fine Arts of the Municipality in which this contract was drawn up.
Sale, rental, display in public and private exhibitions, any inter vivos and/or mortis causa transfer, reproduction and/or use rights of this work or its image are subject to the aforementioned conditions and everyone is required to observe them.
You expressly declare that you accept all the conditions set out and at the same time declare that you are directly committed to the artist.
Order Acceptance Policy
Payment must be made via the payment methods available on the site. The receipt of an electronic or other order confirmation does not constitute our acceptance of your order, nor does it constitute a confirmation of your order or our offer to sell. We reserve the right, without prior notice, to accept or refuse your order or limit the order quantity for any reason. For credit card payments, such payment is subject to the approval of the financial institution issuing the credit card and we will not be liable in any way if such financial institution refuses to accept or honor the credit card for any reason. We may also request additional verification or information before accepting any order.
Address Change Policy
If you do not enter the correct address on your order for shipping and if the order has already been shipped and the address needs to be changed, you will be charged for the additional shipping required to get the product to the correct address. Please be careful when entering your details to ensure your address information is correct on your order. We process orders as quickly as possible and they are often shipped before you can contact us to make a change.
Typographical errors
In the event that a product is listed at an incorrect price or with incorrect information due to a typographical error or error in pricing or product information, we shall have the right to refuse or cancel any orders placed for products listed at the incorrect price. We shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is cancelled, we will immediately issue a credit to your credit card account in the amount of the charge or if this fails we will use the information you entered to complete the refund as soon as possible.
Product availability and prices
We cannot guarantee product availability and, however, these items may not be available for immediate delivery. We reserve the right, without liability or prior notice, to revise, discontinue or cease to make available any or all products or to cancel any orders. Prices in the online store are valid for in-stock quantities and vouchers only when purchased through our website. If you require additional items beyond those available, please contact us for prices.
Shipping and delivery
We ship with Mail Boxes Etc. We are not responsible for any shipping problems and cannot be held responsible for any "reasonable" delays beyond our delivery times. Shipping times are calculated from order processing. Due to high demand, order processing may take 1 to 2 business days. We will not be responsible for delivery delays due to causes external to us. The terms and conditions of the couriers used for shipping apply, which can be documented online on the relevant websites.
